The "screen protector" is the same overlay design as every other display that uses glass. It's a safety measure. The alternative is once again returning to a plastic overlay that gets scratched and warped, which you would probably throw a screen protector on anyway.
As for bricking of consoles, how much would you like to bet that this only gets used in cases of severe piracy and theft?
The whole "this may apply to physical cartridges" fear mongering just shows you weren't around at all for Blizzard in the 2000s, where they could ban your CD-KEY and prevent you from going online or receiving updates. If Nintendo actually encoded each cartridge uniquely or added an e-fuse, GameStop wouldn't be expecting to resell anything.
Digital games SHOULD ALWAYS be cheaper than physical ones. You can debate about the price of the game, but sorry, my entertainment shouldn't cost as much as your "investment".
And as for forced arbitration, what device are you using right now? Probably something Apple, if I had to guess.

There's an undocumented Day 1 patch you MUST download in order to use the console at all.
Nintendo has the "right" to brick your entire console for almost any reason, at any time. This is for online and offline play.
Same applies to physical cartridges. This dramatically endangers the resale market, as you can't be entirely sure if a particular console is slated to be rendered inoperable due to a past policy violation. This is by design.
Two words: Forced arbitration.
Physical games are priced significantly higher than digital ones.
The screen is packed so close to the cardboard, many are being damaged in shipping -- and even attaching a receipt to the box via a staple can damage the console.
